The European Commission has launched an evaluation of the Dual‑Use Regulation. This regulation sets rules for the export, transit and brokering of so‑called “dual‑use items”: goods, software and technology that can be used for both civilian and military purposes, including applications related to weapons of mass destruction or potential human rights violations.
Input from stakeholders is essential to identify unintended effects of the regulation, assess compliance challenges, and explore improvements that align with the EU’s strategic autonomy and its commitment to global non‑proliferation.
The current regulation (2021) modernised the EU’s export control framework. Under Article 26(4) of the Dual‑Use Regulation, the Commission must carry out an evaluation and report its main findings to the European Parliament, the Council and the European Economic and Social Committee.
The evaluation should clarify the extent to which the regulation achieves its objectives: contributing to international peace and security by preventing the spread of weapons of mass destruction and safeguarding respect for fundamental rights and international humanitarian law. At the same time, the regulation should limit unnecessary burdens on legitimate trade, ensure a level playing field for exporters in the internal market, strengthen the global competitiveness of EU dual‑use industries, and support innovation and international research cooperation.
Who can contribute?
The Commission invites a broad range of stakeholders to provide input:
- Companies, industry associations, research institutions and academic organisations are invited to share their broader sectoral and substantive perspectives through a targeted consultation. Contributions could be submitted until 11 September 2026.
- The general public and civil society organisations can respond via the open public consultation and its accompanying questionnaire. You can submit your input until 15 October 2026.
Your input matters
The Ministry of Foreign Affairs calls on all stakeholders to share their experiences, concerns and recommendations through the consultation process. Your input will directly contribute to a better and future‑proof implementation of the European export control system.
